QSGA Chance to WIN up to $100k with 10 chances to win
- Information on how to enter and prizes forms part of these Terms and Conditions of entry. Participation in this promotion is deemed acceptance of these Terms and Conditions of entry.
- Entry is only open to temporary and permanent Queensland residents, over 18 years of age who work for an employing strawberry farm that is a current member of QSGA as of 5.00pm AEST on 22/3/21 (“Participating Farm”). Beneficial owners (Business owners) of a QSGA membership, employees of the Promoter, and agencies associated with this promotion are ineligible to enter.
- All entrants must be legally allowed to work in Australia for the entirety of the Promotional Period and be able to provide evidence of their legal working status to the Promoter at any time if requested to do so.
- Registrations for “QSGA Chance to Win $100k with 10 chances to win” promotion commences at 6.00am AEST on Thursday 8/4/21 (the “First Registration Date”). Entries open at 12:01am AEST on Tuesday 1/6/21 (the “Opening Date”). Registrations close and entries must be received by the Promoter via the entries email box at pickpackwin@qldstrawberries.com.au by 5.00pm AEST on Monday 4/10/21 (the “Closing Date”). The period between the Opening Date and the Closing Date (inclusive) is the “Promotional Period”.
How to Enter and accumulate entries:
- To be eligible to enter, entrants must register with the Promoter via the Registration Portal (the “Portal”)
- each entrant must have accumulated at least one thousand (1000) entry points before they will be eligible for this promotion.
- An ‘Average Working Week’ is defined as the average full-time work equivalent for the employing farm business for each week of the Promotional Period. The amount of working hours in an Average Working Week will vary at each Participating Farm during the Promotional Period. The first Average Working Week will start on the Opening Date (Tuesday 1/6/21) and there will be a total of eighteen (18) Average Working Weeks during the Promotional Period.
- All entry points must be earned for an entrant’s work on a Participating Farm – work that is not completed on a Participating Farm will not be eligible for entry points. You can view the list of Participating Farms at qldstrawberries.com.au/QSGA-farms.
- Entrants can receive bonus entry points for registering for the promotion by 31/5/21. These bonus entry points will be awarded as follows:
- For all entrants who have registered at the Portal after the opening date and received a registration confirmation from the promoter prior to 11.59pm AEST on Friday 30/4/21, and have completed at least two (2) Average Working Weeks during June or July 2021, that entrant will receive seven hundred and fifty (750) bonus entry points.
- For all entrants who have registered at the Portal after 11.59pm AEST on Friday 30/4/21 but have received a registration confirmation from the promoter prior to 11.59pm AEST on Monday 31/5/21, and have completed at least two (2) Average Working Weeks during June or July 2021, that entrant will receive two hundred and fifty (250) bonus entry points.
- For each and every ‘Average Working Week’ that an entrant works for a Participating Farm during the Promotional Period, they will receive one hundred (100) entry points. For the avoidance of doubt, an entrant must work an entire Average Working Week to receive any entry points – no entry points will be awarded to an entrant who has not completed an entire Average Working Week. Once an entrant accumulates one thousand (1000) entry points, they will receive one thousand (1000) entries into the Draw. For each entry point accumulated after the first one thousand (1000), they will receive one (1) additional entry into the Draw.
- Entrants can also receive bonus entry points for completing consecutive Average Working Weeks at a single Participating Farm. These bonus entry points will be awarded as follows:
- For any entrant who completes eight (8) consecutive Average Working Weeks at a single Participating Farm during the Promotional period, they will receive eight hundred (800) bonus entry points.
- For any entrant who completes twelve (12) consecutive Average Working Weeks at a single Participating Farm during the Promotional period, they will receive one thousand six hundred (1600) bonus entry points.
- For any entrant who completes sixteen (16) consecutive Average Working Weeks at a single Participating Farm during the Promotional period, they will receive five thousand (5000) bonus entry points.
An entrant can receive all of the above bonus entry points if completed in succession. For example, if an entrant completes eight (8) consecutive Average Working Weeks, they will receive eight hundred (800) bonus entry points, and if they work an additional four (4) consecutive Average Working Weeks, for a total of twelve (12) consecutive Average Working Weeks, the entrant will receive an additional one thousand six hundred (1600) bonus entry points, for a total of two thousand four hundred (2400) bonus entry points, and if the entrant proceeds to complete an additional four consecutive Average Working Weeks, the entrant will receive five thousand (5000) bonus entry points in addition to the previously earned bonus points.
For the avoidance of doubt, these bonus entry points can only be earned for completing consecutive Average Working Weeks at one (1) Participating Farm – if an entrant completes four (4) consecutive Average Working Weeks at one Participating Farm and immediately after, completes an additional four (4) consecutive Average Working Weeks at a different Participating Farm, the entrant will not be entitled to any of the above bonus entry points. However, if an entrant completes eight (8) consecutive Average Working Weeks at one Participating Farm and immediately after, completes an additional eight (8) consecutive Average Working Weeks at a different Participating Farm, the entrant will be entitled to two sets of eight hundred (800) bonus entry points (for a total of one thousand six hundred (1600) bonus entry points).
- Each Participating Farm will provide to the Promoter the number of entry points for each Entrant at the end of each pay period during the Promotional Period. This information will be collated confidentially and managed by an independent data processing consultant. It is the responsibility of the Participating Farm to submit the entry points on behalf of the entrants for each pay period.
- An entrant can only earn entry points for one Average Working Week within each calendar week during the Promotional Period. Duplicate entry points submitted for an entrant within the same Average Working Week will be deemed invalid.
- The Draw shall take place at TSL Family Farms, 210 Stern Road, Bellmere Qld 4510 at 4.00pm AEST on Thursday 14/10/21.
- The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
- The first ten (10) entrants drawn by randomised selection from the total entries will win the opportunity to participate in a “Game for the chance to win $100,000” as one of ten (10) “Contestants”. Winners will be notified by phone and email.
- The Promoter’s decision is final, and no correspondence will be entered into.
- It is valid for one entrant to be drawn as a Contestant more than once. Each Contestant drawn will have the right to play the Game in accordance with these Terms and Conditions even if that means an individual plays the Game more than once.
- QSGA reserves the right to verify the validity of Participating Farms, entry points, entries and entrants (including but not limited to an entrant’s identity, age, working history with Participating Farms during the Promotional Period) and reserves the right, in its sole discretion, to disqualify any Participating Farm or entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process, or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion, or whose entry points or entries are not in accordance with these Terms and Conditions of entry . Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- Late, incomplete, indecipherable or illegible entry points or entries will be deemed invalid.
- If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
- Multiple entries are permitted, subject to the following: (a) only one (1) set of entry points permitted per entrant; (b) each entry must be submitted in accordance with entry requirements; and (c) a maximum of nine thousand, nine hundred and fifty (9,950) entries permitted per person.
Game for the chance to win $100,000 (“the Game”)
- The Contestants will participate in the Game at the Sandstone Point Hotel, 1800 Bribie Island Rd, Sandstone Point QLD 4511 at 2.30pm AEST on Thursday 21/10/21.
- For the Game there will be a strawberry patch containing 100 strawberry punnets numbered from 1 to 100. Each punnet will correspond to 1 of 100 security envelopes on display at the commencement of the Game. Of the 100 security envelopes, one (1) will contain a message representing the $100,000 Major Prize and ninety-nine (99) will contain a Consolation Prize of $1,000. The Contestant or their proxy must select one (1) of the 100 punnets from the strawberry patch. The envelope with the corresponding number will then be selected from the set of 100 security envelopes. Once the Contestant has selected the security envelope by selecting a numbered punnet, the prize revealed is the prize won, no further security envelopes may be selected and, subject to verification by the Promoter, the Contestant will be awarded the prize shown in the one (1) selected security envelope as their prize (either the $100,000 Major Prize or the $1,000 Consolation Prize). When the Contestant selects a security envelope, they must do so without touching, handling or interfering in any way with any of the other security envelopes on display.
- Any and all costs associated with attending the Game are the sole responsibility of the Contestant. The Contestant may participate in the Game via telephone whereby they will select a number between 1 and 100 (inclusive) and a representative of the Promoter will select the security envelope bearing that number on their behalf. If the Contestant cannot attend the Game, the Contestant may appoint a proxy over 18 years of age to play the Game on their behalf provided the Contestant gives the Promoter written, signed notice to that effect before the start of the Game. If the Promoter has not been able to contact the Contestant before the start of the Game, a representative of the Promoter will play the Game on the Contestant’s behalf.
- The Game will be repeated with a new set of security envelopes for each of the ten (10) Contestants.
- The odds of winning each of the $100,000 major prizes, once selected as one of the ten (10) Contestants, are 1 in 100. The odds of being drawn as a Contestant may be significantly higher than the odds of the drawn Contestant winning the major prize and will depend upon the total number of entries received.
- Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
- Cash prizes will be awarded by way of electronic funds transfer (EFT) into each Contestant’s bank account.
- Prizes are not transferable or exchangeable, unless otherwise specified.
- In the event that a Contestant(s) cannot be contacted via phone or email, an unclaimed prize draw will take place at the same location as the first draw, at 4.00pm AEST on Tuesday 26/10/21 where any prize(s) selected by the Promoter’s representative when the Game was originally played will be awarded to the entrant(s) drawn in the unclaimed prize draw. Any subsequent winners will be notified in accordance with these terms and conditions.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the Promoter’s website is the entrant’s responsibility and is dependent on the Internet service provider used.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by or on behalf of that entrant invalid.
- Total prize pool value is up to $1,000,000.
- As a condition of accepting the prize, any Winner must sign any legal documentation as, and in the form, required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Participating Farms (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Participating Farms (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry point, entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of/taking of a prize.
- Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- The Promoter and the Participating Farms collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.qldstrawberries.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter and the Participating Farms may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Entrants should direct any request to access, update or correct information to the Promoter and the Participating Farms. The Promoter will not disclose PI to any entity outside of Australia. All entries become the property of the Promoter and the Participating Farms.
